Selling Bath & Beauty on Etsy: Compliance Guide

In the US, the FDA regulates cosmetics. Products applied to the body for cleansing or beautifying are classified as cosmetics and must include ingredient lists (in INCI format), net weight, manufacturer name and address, and proper warnings. The EU has even stricter rules under the EU Cosmetic Regulation. Etsy does not enforce these laws directly, but non-compliance exposes you to legal liability and shop issues.

Claiming your bath or beauty product treats, cures, or prevents any medical condition transforms it from a cosmetic to a drug in the eyes of regulators. Claims like "cures eczema," "heals acne," or "reduces inflammation" are prohibited unless your product is registered as a drug. Even on Etsy, such claims can trigger listing removal and are considered prohibited items.

Every ingredient in your bath and beauty products must be listed accurately. Common allergens like tree nut oils, fragrances, and essential oils should be clearly disclosed. If you reformulate a product, update the listing immediately. Inaccurate ingredient lists pose health risks to buyers and serious legal liability for sellers.

Handmade bath and beauty products must be made by you or by a disclosed production partner. White-labeling (buying generic products from a manufacturer and adding your own label) does not qualify as handmade on Etsy unless you significantly formulate or customize the product. Disclosure of any production partner involvement is required.
